These Terms of Use (“Terms”) govern your use of the Balcony Bounty website and your purchase and use of the Balcony Bounty digital guides and printables (the “Products”). The website and Products are provided by Insight Agência de Marketing LTDA, a company organized under the laws of Brazil, CNPJ 54.884.128/0001-94, SES Quadra 13, Lote 11, Sobradinho, Brasília-DF, 73020-413, Brazil (“Balcony Bounty”, “we”, “us”). Contact: support@balconybounty.online.
By buying or using the Products you agree to these Terms. If you do not agree, do not buy or use them.
1. What you are buying
The Products are downloadable PDF files in English, sold together as one set, the Balcony Bounty Container Garden Starter Kit: the guide, the planting calendar, the quick reference card, the shopping list, the companion planting chart and the garden planner. The set is a one-time purchase. There is no subscription, no free trial that converts to a paid plan, and no automatic renewal. The price shown at checkout is the total price for the Product, before any sales tax that applies where you live.
The Products are digital. Nothing is shipped. Pots, soil, seeds and plants are not included.
2. Payment and delivery
Payments are processed by [payment platform], which may act as the merchant of record and reseller of the Products. Its own terms and privacy policy also apply to your purchase. After payment you receive a download link on screen and by email to the address you gave at checkout. If the email does not arrive within an hour, check your spam folder and then contact support@balconybounty.online.
3. Who can buy
You must be at least 18 years old to buy the Products.
4. General gardening information
The Products are general gardening information for home use. They are based on publications of U.S. university Cooperative Extension services and on public climate data from NOAA. They have not been tailored to your home, climate, soil, water or health, and they are not professional agronomic, structural, medical or nutritional advice.
- Planting dates are estimates. Frost dates are long-term averages from the nearest weather station, not forecasts. A frost can happen after the average last frost date or before the average first frost date. Check your local forecast before planting outdoors.
- Balconies and railings have weight limits. Wet soil is heavy. You are responsible for checking with your landlord, building manager or a qualified professional what your balcony, deck or railing can safely hold, and for following your lease or homeowner association rules.
- Food safety is your responsibility. Wash what you harvest, use containers and water that are safe for growing food, and follow the label of any fertilizer or pest product you use.
- Herbs are covered as food. Nothing in the Products is a claim that any plant prevents, treats or cures any disease.
5. No promise of results
Plants are living things. We do not promise or guarantee any specific result, including any harvest, any harvest by a certain date, or any saving on groceries. Time-to-harvest figures are typical ranges published by university Extension services for short-season plants under good growing conditions; your results depend on weather, light, watering, the varieties you choose and other factors outside our control. Prices in the shopping list are estimates and change by store and by date.
6. Refunds
You can ask for a refund within 14 days of purchase. The Refund Policy explains how.
7. License and permitted use
When you buy a Product we grant you a personal, non-exclusive, non-transferable license to download it, keep copies on your own devices and print it for your own household use. You may not resell, share, publish, upload or distribute the Product or any part of it, or use it to create a competing product. All rights not expressly granted are reserved.
8. Intellectual property and independence
The text, design, illustrations and layout of the Products and website belong to us or our licensors. Balcony Bounty is an independent publication. It is not affiliated with, sponsored by or endorsed by NOAA, the USDA, the U.S. Census Bureau, any university or Extension service, or any store or brand mentioned as an example.
9. Disclaimer of warranties
The website and Products are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any property damage, crop loss, personal injury or health problem, arising from your use of the Products or website. Our total liability for any claim relating to a Product is limited to the amount you paid for that Product. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Governing law and disputes
These Terms are governed by the laws of Brazil, and the courts of Brasília, Federal District, Brazil, have jurisdiction over disputes about them. Before starting any formal claim, please contact us at support@balconybounty.online so we can try to resolve it directly. Nothing in these Terms removes consumer protections you have under the mandatory law of the place where you live, including your right to bring a claim in your local courts where that law gives it to you.
12. Changes
We may update these Terms. The version in force on the date of your purchase applies to that purchase. We will post the updated version on this page with a new “Last updated” date.
